Baby Changing Station Laws in California

Baby Changing Station Laws in California

Baby changing station laws in California can be confusing, as many companies have misinformation on their websites. State law AB-1127 was passed in 2017, and requires a baby diaper changing station in one at least one women’s room, and one men’s room in most public buildings. These include buildings with maximum occupancies over 60 people, shopping centers greater than 25,000 square feet and retail stores over 5,000 square feet, but doesn’t include nightclubs and bars.

Federal Baby Changing Laws Applicable in California

- Recently passed S.1110 - Friendly Airports for Mothers Act of 2017, requires a lactation room for mothers in all terminals in all medium and large “hub” airports, and not a baby changing station, as reported by other websites.

- The Bathroom Accessible In Every Situation Act (BABIES Act) is a law for federal buildings, requiring them to have a baby changing station in women’s and men’s rooms.

Baby Changing Station Laws in California FAQ

Does the ADA require baby changing stations in California?

No, the ADA doesn’t require baby changing stations in California buildings. The American with Disabilities Act (ADA) doesn’t require baby changing stations by law, but the Bathroom Accessible In Every Situation Act (BABIES Act) requires that at least one baby changing station be available in a women’s room, and a men’s room, in all federal buildings, including in California.

Are baby changing stations required in California restaurants?

Yes, baby changing stations are required in California restaurants. State Law AB-1127 requires that there should be baby changing stations in at least one women’s room, and one men’s room. This baby changing station law is statewide, and should be implemented in all California restaurants.

Are baby changing stations required in California men's rooms?

No, baby changing stations aren’t required by law to be in all men’s restrooms. Baby changing stations are, however, required to be in every building. This means that every public building (and every federal building as required by the BABIES Act), should have a baby changing station in at least one men’s bathroom. This may be different in San Jose, who may have a baby changing station in all men’s rooms.
